Should judges making custody decisions by listening to the kids? These days this is a hot subject in Household Law. Years ago the answer to the concern was an emphatic "no". Children were unreliable witnesses, they did unknown exactly what was great for themselves, and they would be distressed permanently by being asked to pick one parent over the other. They would figure out that they were in a position to control the result, which would turn the parent-child relationship upside down.
